1. Scope
These terms apply to all sales made through hc-health-trading.com to professional buyers acting for their business. Placing an order means accepting these terms. They prevail over any buyer’s general terms.
2. Products
Products are described as accurately as possible from manufacturer and supplier information. Photos are for illustration. Compliance documents (such as CE marking and declarations of conformity) are available on request. The buyer is responsible for checking the rules that apply to the resale of the products in its market.
3. Prices
Prices are in euros, excluding VAT and shipping, per unit. VAT is added at the rate applicable at the time of the order. We may change prices at any time; the price applicable is the one displayed when the order is confirmed.
4. Minimum order and availability
Each product has a minimum order quantity shown on its page. Stock shown is indicative and may change. If a product becomes unavailable after the order, we inform the buyer and offer an alternative, a later delivery or a refund of the amount paid.
5. Orders and payment
An order is confirmed when we have received the payment. Accepted payment methods: bank transfer and bank card (via Stripe). We place the corresponding order with our supplier after receipt of the payment. Late payment of an invoice leads to interest at three times the legal rate and a fixed recovery fee of 40 euros, as provided by law.
6. Delivery
We deliver to France and the European Union. Delivery times are indicative and confirmed on request; a delay does not give right to damages or cancellation unless agreed in writing. Risk passes to the buyer on delivery.
7. Inspection and claims
The buyer checks the goods on delivery and reports any damage, shortage or non-conformity within 5 working days of delivery, as described in our returns and refunds policy.
8. Warranty and liability
Products benefit from the legal warranty against hidden defects and, where applicable, the manufacturer’s warranty. Our liability is limited to the price of the goods concerned, except in case of gross negligence or wilful misconduct. We are not liable for indirect losses.
9. Personal data
See our privacy policy.
10. Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control.
11. Governing law and jurisdiction
These terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the Commercial Court of Lyon.
